1. Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement made between you ("User", "you") and Diogen AI ("we", "us", or "our"), concerning your access to and use of the diogenwp.com website and the Diogen AI WordPress plugin (collectively, the "Service").
By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and must discontinue use immediately.
2. The Service (WordPress Plugin)
Diogen AI provides a WordPress plugin designed to automate content generation and publishing by connecting to third-party AI services. We offer both a free version and a premium (PRO) version equipped with advanced features.
3. User API Responsibilities and Costs
The Diogen AI plugin requires you to bring your own API keys for third-party services (such as OpenAI, Google Gemini, Stability AI, and Leonardo AI) in order to generate content.
- API Costs: You are solely responsible for setting up accounts with these third-party providers and for paying any associated costs, fees, or overages incurred by the API usage generated by the plugin.
- Provider Terms: Your use of the plugin to interact with these third-party services is subject to their respective Terms of Service and acceptable use policies. Diogen AI is not responsible if your account with a third-party provider is suspended, limited, or terminated.
- No SLA on external APIs: We do not guarantee the uptime, availability, or continued access to any specific third-party AI provider.
4. Intellectual Property
- Your Content: You retain all ownership rights to the content, text, and images generated on your WordPress website using the Service. We claim no ownership over the output produced by your prompts.
- Our Software: The Diogen AI plugin code, branding, logos, and website design are our intellectual property. The free version of the plugin available on the WordPress.org repository is licensed under the GPLv2 (or later). The PRO version may be subject to a commercial license agreement provided at the time of purchase.
5. Payments and Subscriptions
All premium purchases and subscriptions are processed by our Merchant of Record, Lemon Squeezy.
- When you make a purchase, your transaction and payment details are securely processed by Lemon Squeezy, subject to their terms and conditions.
- Subscriptions are billed in advance on a recurring basis as per your selected billing cycle.
- Refunds and cancellations are subject to the policies set forth during the checkout process managed by Lemon Squeezy. Contact us for any billing disputes or refund requests.
6. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Diogen AI, its affiliates, directors, employees, or agents be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service.
We are not liable for any content generated by the AI that is deemed offensive, inaccurate, plagiarized, or otherwise unsuitable, nor are we liable for any technical issues caused on your WordPress installation by using our software.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
8. Modifications to the Service and Terms
We reserve the right to modify or discontinue all or part of the Service without notice at any time. We also reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
